Pre-Foreclosure Leads in Hillsborough County: What's Public and How to Approach Owners

By the SBS team · October 12, 2026 · 6 min read

Hillsborough's clerk publishes every recorded lis pendens. What that filing means, how to reach the owner respectfully, and the Florida rules agents must follow.

Where pre-foreclosure leads come from

Florida is a judicial foreclosure state, so a lender starts by filing a lawsuit and recording a lis pendens, a public notice that a case affects the property. The Hillsborough County Clerk publishes a daily index of everything recorded in Official Records, including lis pendens, so a new filing can be spotted within a business day.

A lis pendens is not a sale date. Many cases end in a loan modification, a payoff or a sale by the owner. That is exactly the window where a listing can help: a market sale often leaves the owner with more than an auction would.

How to approach the owner

The Florida rule to know

Florida's foreclosure-rescue statute, section 501.1377, restricts anyone offering to help a homeowner avoid foreclosure, including bans on up-front fees and requirements for written contracts with cancellation rights. Agents who stick to listing the home for sale and say so plainly stay away from that territory. Ask your broker or a Florida attorney how it applies to you.

SBS watches the filings for you

SBS for Real Estate checks Hillsborough's daily recordings, matches new lis pendens to properties in your ZIP codes, and adds them to your weekly lead feed with a respectful listing-focused letter ready to print. Other Florida counties are being added as their clerks' data allows; every county already gets absentee, long-time, new-owner and LLC leads.
